Celeste Rivas Hernandez’s family has filed a wrongful death lawsuit against musician D4vd in Los Angeles County Superior Court this past Monday. 21-year-old D4vd, whose real name is David Burke, is accused of having repeatedly sexually assaulted the 14-year-old before murdering her and dismembering her body, and is currently set for trial, where he has pleaded not guilty.

​Mercedes Martinez and Jesus Rivas, Celeste’s parents, seek damages from Burke for his alleged murder of their daughter. The lawsuit also claims that Josh Marshall, Burke’s manager; Colleen Burke, Burke’s mom and Sheldon Jacques, Burke’s bodyguard, knew, or should have known, about Burke sexually exploiting Celeste and never stepped in, as reported by Consequence. It specifically accuses Jacques of providing transportation so Celeste could get from her home to Burke’s.

​Celeste’s remains were found in the trunk of a car belonging to Burke last year, and the singer was arrested in April of this year and charged with murder, continuous sexual abuse of a child under the age of 14 and unlawful mutilation of human remains. Prosecutors claim that Burke allegedly murdered Celeste to keep news of their relationship from coming out. It’s been determined that Burke must stand trial, but a formal date has yet to be set.

​Alongside the lawsuit, Celeste’s family also released a statement on Monday calling for the death penalty for Burke if he is convicted. The statement read: “If the death penalty were activated, it would be perfect for this kind of human being, devoid of feelings and emptiness inside, and without conscience, who only caused pain to our daughter, our family, and the world that supports our precious daughter.”
