Classixx is suing H&M for selling unlicensed clothing using the band’s name without permission. The electronic due of Michael David and Tyler Blake filed a lawsuit against the clothing store for copyright infringement, as mentioned by Pitchfork. Classixx sent a cease & desist to H&M prior to filing the lawsuit. The lawsuit was filed in the Central District of California, and contends that H&M were “aware” of the band’s title and trademark due to the fact that their music was played in H&M outlets internationally.
The band’s attorney stated “despite H&M’s blatant infringement of Classixx’s trademark and publicity rights, it denied any liability, threatened Classixx with claims for costs and attorneys’ fees, and insultingly referred to the band as a ‘relatively unknown DJ duo.’” See the full legal complaints and social media posts regarding the copyright below.
