In New Jersey, US District Judge, Faith S. Hochberg, has thrown out almost one thousand subpoenas for a BitTorrent suit that involved Italian band, Lacuna Coil’s new album, Dark Adrenaline. The judge ruled that the case wrongly joined mass defendants together. Hochberg has thrown out all of the defendants except for one for the claim and has stated:
“There must be a connection between defendants beyond the copyrighted work and method of distribution, namely that defendants were involved in the same transaction with the same downloader at the same time.”
A New Jersey attorney on behalf of Century Media Records filed the suit. Like with most illegal-downloading cases, the lawyer hired a company to search for Internet protocol addresses linked to file-sharing sites such as BitTorrent. Then the lawyer subpoenas all of the associated IP addresses. Once charged, the Internet account holder can settle the case for a few thousand dollars or hire a lawyer to fight the charges.
Century Media Records isn’t the only record embroiled in illegal-downloading cases. Earlier this year, Nuclear Blast Records filed a lawsuit against 80 BitTorrent users over downloading an All Shall Perish Album.
