Electro glitchpop artist and formerly one half of Crystal Castles Alice Glass has announced that she has defeated her ex-bandmate Ethan Kath in court a second time around, and this time he is liable for paying her legal costs after losing his appeal.
The claims about the ongoing legal dispute were made on Twitter, where she said “Oh and the bullshit lawsuit by my former bandmate was once again denied in his appeal attempt today. Now he owes us legal fees.”
Kath had filed a defamation suit against Glass when she publicly accused him last fall of raping her and continuously abusing her for years before she left the duo in 2014. Kath argued that the claims were slanderous, referring to them as “pure fiction.” After Glass, more women have accused Kath of sexual abuse.
Kath’s suit was denied earlier this year in late February, when Glass’ legal team was able to prove that her words were protected under the First Amendment’s Freedom of Speech clause, and as a part of the larger #MeToo movement were made in the public interest.
Kath’s team, on the other hand, were unable to definitively prove that her statements were false, which is usually crucial to a high profile defamation suit. That being said, the legal battle between Kath and Glass continued as the former attempted an appeal and the latter’s lawyer Vicki Greco sought payment of legal fees from Kath, approximately $20,000 USD.
According to a court order that was obtained by Pitchfork, Los Angeles Court Judge Samantha Jessner decided to deny Kath’s appeal to vacate the first defamation suit’s dismissal. Jessner found that cases where “a party has the opportunity to file an opposition to a motion, but fails to do so effectively,” which holds true for Kath, does not constitute a reason for the vacation of a dismissal. Jessner also granted Glass a total of $20,882.69 from Kath in attorney fees and costs.
Doubling down, however, Kath’s legal team seems to be planning to appeal once more, claiming that Kath maintains that all allegations of abuse are false and were made maliciously and for publicity.
Glass’ tweets have garnered a slew of online support, including brief messages of affirmation from Zola Jesus, whom Glass has been touring with since late April to today, May 17, and feminist writer Dianca London.
