Pop punk/emo band Yellowcard will be continuing their $15 million lawsuit against rapper Juice WRLD after his death. which occurred earlier this month. While the band had originally put the lawsuit on hold after his death on December 8, the group decided to extend the suit, giving the rapper’s estate, his producers Nick Mira and Taz Taylor, along with the labels Interscope and Grade A Productions until February 4 to respond to the band’s legal complaint.
The band claim that the rapper’s 2018 breakout hit hit “Lucid Dreams” copied “melodic elements” from their 2006 album track “Holly Wood Dies.” The plaintiffs claim that both tracks use a “melisma idiosyncrasy”, melisma being the term for singing multiple notes within one syllable of text.
In addition to their pursuit of $15 million in damages, the band is seeking out “running royalty and/or ownership share” for future uses of the track. They has also sought out money from all future Juice WRLD tours and public appearances.
“As alleged in the complaint, this is not just a generic emo rap song, but is a blatant copy of significant original compositional elements of ‘Holly Wood Died’ in several respects,” Yellowcard’s lawyer, Richard Busch, said in a press statement to Rolling Stone.
The rapper had suffered a seizure at the Midway Airport in Chicago, where he reportedly began suffering from convolutions, before going into a cardiac arrest. The rapper’s girlfriend alleged that he had taken a Percocet at the time of his seizure, and that he had suffered from substance abuse issues.
