Kesha’s Countersuit Against Dr. Luke Is Denied

Pop artist Kesha has had her recent counter suit against prominent music producer Dr. Luke denied once again, after The  New York Court of Appeals 1st Department found her appeal “palpably insufficient and devoid of merit.” The court also added that the counterclaims were “speculative, contradicted by her own allegations that she had continued performing under the agreements.”

Dr. Luke is suing the performer for defamation, which stems from the performer’s abuse allegations which arose several years ago. In 2014 Kesha began her suit against Dr. Luke, alleging that the producer drugged and sexually, physically, verbally and emotionally abused her. The performer dropped the sexual abuse lawsuit in 2016, however the performer has still attempted to break out of her contract with the producer several times by countersuing against his defamation claims, with her appeal in 2018 being rejected once again.

The producer has called her original allegations “defamatory,” and is continuing to pursue his defamation suit to recuperate “substantial damages for this malicious conduct,” stemming from her original allegations.

This lawsuit has involved other prominent performers into the fray, with Lady Gaga giving deposition to the court back in 2017. Attorneys from Dr. Luke’s camp have disputed Lady Gaga’s testimony, claiming that the performer “has no knowledge of what happened on the night at issue because she was not there.”

While little is known about the night in question, besides the testimony given by Dr. Luke’s attorneys, Lady Gaga, and Kesha herself; Lady Gaga has continued to defend Kesha. “What we discussed was, what I recall was her immense sadness and depression and fear,” Gaga said in her testimony. “She was visibly very different than when I had seen her before, and — but I can’t say specifically what exactly we spoke about. I just recall that it was emotional, and I wanted to be there for her.”
