Kanye West and Pusha-T are reportedly the targets of a lawsuit from FAME Enterprises Inc. for the unauthorized samples and drug-based content on DAYTONA, according to Pitchfork.
American rapper Pusha-T made his solo debut and joined Kanye West’s G.O.O.D. Music label in 2011. Produced by West, DAYTONA is Pusha-T’s most recent album, which was nominated for Grammy Awards “Rap Album of The Year.” West and Pusha-T sampled George Jackson’s 1972 song “I Can’t Do Without You” in one of the album tracks “Come Back Baby” without permission from the owner, TUSCUMBIA — FAME Enterprises Inc., who has the track copyrights.
FAME has filed a suit on May 24 in the Circuit Court of Colbert County, Alabama. FAME’s lawyers claim in the lawsuit, “The worldwide rights to the sound recording ‘I Can’t Do Without You’ are 100% owned by FAME.” They believe more than 35 percent of “Come Back Baby” unauthorizedly use the verse from the late Southern soul singer’s “I Can’t Do Without You” as the following:
“Never have I been locked up in a world of misery
I need you darlin’ to set me free
Come back, baby, try me one more time
Ooh, baby, I’m ’bout to go out of my mind
I can’t—”
Besides, FAME sued the content of drug addiction in “Come Back Baby.” They disagreed to license the song “for such a use under any circumstances.” The lawsuit also against UMG Recordings, Def Jam and G.O.O.D. Music that “have a pattern and practice of willfully sampling sound recordings without consent or permission.”
