Poison Sues Capitol Records

Poison filed suit against Capitol Records and EMI Music Marketing on June 18th, 2008. The band jointly filed a complaint, under Sweet Cyanide Music, Inc. and as individuals, for breach contract by Capitol Records against the collective plaintiffs, for breach of contract by EMI Music Marketing against the band Poison, for breach of contract by both defendants against C.C. DeVille (due to his departure from the band in 1991), for unjust enrichment of the defendants based on the allegations outlined in the three breaches of contract, and for accounting.

Collectively, they are demanding general, special, and incidental damages against Capitol Records and EMI Music Marketing in an amount to be proven at trial and an imposition of a constructive trust over the amount of money that should have been due to them throughout the years, as well as attorneys fees, legal fees, and “for such other and further relief as this court may deem just and proper.”

Poison, with the original lineup of Bret Michaels, C.C. DeVille, Bobby Dall, and Rikki Rockett, will continue to tour throughout the summer. Michaels
